ARIZONA SAFARI JEEP TOURS TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

By uploading photos, videos, or other media (collectively, “Content”) through our form, you (“User”) agree to these Terms of Service (“Terms”). These Terms constitute a binding agreement between you and Arizona Safari Jeep Tours, and govern your participation in the media sharing program and contest.

If you do not agree to these Terms, do not upload any Content.

2. MEDIA RELEASE AND OWNERSHIP

  1. License Grant: By submitting Content, you grant Arizona Safari Jeep Tours , its affiliates, and subsidiaries (“Company”) a perpetual, irrevocable, royalty-free, worldwide, non-exclusive license to use, reproduce, modify, adapt, publish, distribute, publicly display, and create derivative works from the Content in any medium or format, for any purpose, including but not limited to marketing, advertising, promotional materials, and social media.
  2. Transfer of Rights: You further agree to transfer ownership of the submitted Content to the Company, relinquishing any claims, rights, or interests in the Content.
  3. Representation and Warranty: By uploading Content, you represent and warrant that:
    • You are the sole creator and copyright owner of the Content or have obtained all necessary permissions to upload it.
    • The Content does not infringe on the rights of any third party, including copyright, trademark, privacy, or publicity rights.
    • The Content does not contain unlawful, defamatory, or obscene material.
  4. Indemnity: You agree to indemnify and hold the Company harmless from any claims, damages, or liabilities arising out of or related to your Content.

    This agreement is subject to our privacy policy.

3. CONTEST RULES

  1. Eligibility:
    • The contest is open to legal residents of the United States who are 18 years of age or older.
    • If a selected winner is found to be under 18 years of age, a new winner will be drawn, and this process will continue until an eligible winner is selected.
    • Employees of Arizona Safari Jeep Tours, Sedona Off-Road Center and Arizona ATV Adventures and their immediate family members are not eligible to participate under “customer contest”.
  2. Entry Period and Prize:
    • Each uploaded Content submission automatically enters the User into the monthly contest.
    • The monthly prize is $100, which may be awarded in the form of a gift card at the Company’s discretion.
  3. Winner Selection:
    • One winner will be chosen randomly from all submissions received during the month.
    • The winner will be selected by a third-party partner on the 1st of each month and notified by email, phone, or direct mail by the 5th of the month.
    • If the winner does not respond within five (5) days of the notification, a new winner will be selected on the 10th of the month. This process will repeat every five (5) days until a winner responds.
  4. Disqualification:
    • Submissions containing unlawful or inappropriate content may be disqualified.
    • The Company reserves the right to disqualify any participant for violating these Terms.
  5. Taxes:
    • The winner is responsible for any applicable taxes associated with the prize.

      All contest entries are subject to our privacy policy.

PRIVACY POLICY

By submitting Content, you provide the Company with:

  • Personal contact information, including name, email address, phone number, and mailing address.
  • Uploaded media files (photos, videos).

2. USE OF INFORMATION

  1. Media Use:
    • Uploaded Content will be used in accordance with the Media Release and Ownership section of the Terms.
  2. Contest Administration:
    • Personal information will be used to contact winners and deliver prizes.
  3. Marketing Communications:
    • The Company may use your contact information to send marketing emails, newsletters, or updates, but you may opt-out at any time.

3. INFORMATION SHARING

  1. The Company will not sell or share your personal information with third parties, except as necessary to:
    • Administer the contest.
    • Comply with legal obligations.
  2. Submitted Content may be shared publicly as part of marketing campaigns.

4. DATA SECURITY

The Company takes reasonable measures to protect your personal information from unauthorized access, loss, or misuse.

5. RETENTION OF INFORMATION

The Company retains Content and personal data for as long as necessary to fulfill the purposes described in these Terms, the privacy policy, and as required by law.
